I tend to agree with Jeremy, and if I might add...

Here in Southern California life is just too fast paced to try to get someone to actually stop and take the time to read the verbiage of that release. If there were a rare occasion that they did, they would most likely have to call their personal attorney, or at the least a family member or friend to see what they think, (yes 8 out of 10 people here have an attorney readily available). It would just become too involved to be worth it.

Besides, it seems it would really ruin the candid atmosphere you were after in the first place.

I think for the sake of argument, I might take a release form out one day soon just to see how it goes over.

Jeremy, my post was a reply to bobhate's question about an example of a model release. Who gives the slightest damn about what you would sign or not sign. You crash this thread by posting a rude picture of an old dude giving the sign. You really have no class.

good lord..

anyhow, I was thinking of what Gary said about it being fast paced there.. Try HAVING to get the names of people when they go into a newspaper.. Our policy is not to put a photo in unless we have names - IF there are 5 or less people in the shot.. NOT easy when doing things where people are too busy to want to stop and give you the name.. It's the worst part ever.

As for doing candid shots, I've never worried about getting anything signed because I was under the impression that if it is a public place, and you're not getting money for the photo, it's lawful. I've never had anyone get pissed. And when I look up from the camera (after I've seen they've caught me) I just smile and they usually smile back. I'm nude, of course.. could be they are really laughing :roll:

Lately a lot of people have been asking "Why did you take that picture?" and I can't ever think of a good answer. The guy in today's PaD asked me and I lied, I said I didn't really take a picture. He said he saw it on the LCD when I put the camera down, and I just mumbled something and drove to the second window.

When I started shooting in public places, I also went searching for that definative answer to the question, "Is it Legal to take pictures of people in public without there concent". Even if it is legal, I think it rude to shoot anyone without concent, unless it is in a context of some event.

In my shallow research I found that it was "legal" in a public place, ie don't shoot persons in their house/private property. Shots of houses from the street is legal. Can't quote the actual text, so don't quote me, do your research.

Looks like no one here that is from the legal profession is going to give us one answer. Is a release required or not? If it is, everybody stop shooting and ask first. Obviously it would vary from country to country. If someone could give a professional opinion, it would help us all.
