Looks like a scanned 35mm slide with the black point higher than it should be.
Nikon D300, D200
Nikkor 50mm f/1.8D, 55mm f/1.4 micro, 18-70mm f/3.5-4.5G DX, 80-200 f/2.8D

do u mean it's a film picture ?, the artist uses a Canon 5D Digital Camera.

Dunno, it looks like film to me. Either way, the black point is set higher than what would be normal.

I am pretty sure there is some cross-processing going on. You can download actions for that.

On another picture by this same photographer with much the same feel, he is complimented on his cross-prossing. You can google cross-processing with Photoshop and get some ideas as to whether this is what you are going after.
