Generally I dont's ask permission if they don't know I'm taking the shot. In this case the man was blissfully unaware. As this man is not recognisable from the photo I don't see a problem with this. If I want to take a shot and the person will know I'm talking the shot, then I'll ask.

My gallery of the Lonon Underground is the exception as I would never have got many shots if I'd asked all the people I'd taken shots of. Quite a few were taken covertly.
